Retarded Policeman “Creative Feud” Kills Show

In a creative & financial dispute that began early this year, the people behind YouTube’s popular The Retarded Policeman series recently brought their feud to “court of public opinion.” Mediocrefilm‘s Greg Benson created the show with his wife Kim Evey (who produces The Guild, staring Felicia Day), and hired “Ponce” Perry, who stars as the, well, retarded policeman. Benson also hired Ponce’s brother Scott, who appeared in the first episode, and helped write and direct a few episodes, including the one in which I appeared (so it’s been removed).

Here’s the blow-by-blow:

  • The first episode appeared in September 2007. The most-recent posted video, posted last November (2008), was “Lt. Ballsack” and ironically stars Benson getting pulled over by Ponce.
  • In April, the Perry brothers created the Ponceman account.
  • Five of the episodes have been removed (including the one in which I appeared) because Scott participated in the writing or directing. The rest of the episodes, according to Benson, are his.
  • The DVD is still for sale. Get ’em while they last, folks.
  • The Perry brothers first created a video about the feud, and posted details on their blog. They claim there was an agreement between them and Benson: “We had an agreement with mediocrefilms that has not been honored.  Since the beginning of this year we have tried to work things out but, regrettably, we have reached an impasse. We cannot allow our work on the series to be exploited any longer without our original agreement being honored and all of our attempts to “work something out” with mediocrefilms have been fruitless.”
  • Greg Benson responded to the Perry Brother’s claims in this video, and on his blog. Benson said they had no agreement, and that he paid the brothers thousands of dollars.  He said he offered them various compromises, but was ignored when he requested the Perry brothers to propose terms that would satisfy them.
  • Neither is providing specifics of the terms, and whether the Perry brothers had a “work for hire” or revenue-sharing arrangement.

This debate, only recently brought public, was part of the reason I suggested TheStation (The Station is Doomed) will run into a similar snag. Parenthetically, check out thehill88 and brookers, who provided some informally entertaining responses to that video on their superlazerz channel).

Alas, it’s extremely difficult to collaborate on a channel and share YouTube proceeds, because it’s nearly impossible to determine who contributed to a channel’s success… was it the promotion, producing, writing, acting, directing, editing?

This is the first significant and public feud over ownership rights of a web-video show, and that’s maybe the most surprising piece of news.

So how can you reduce the chances you’ll find yourself in a sad, creative/financial snag like these guys? Get something in writing… the more money a channel earns, the more people will feel cheated unless terms are explicit. Is it 50/50 or are the actors simply paid a flat fee and/or some small percentage of revenue?

It’s no secret I’m a big fan of these guys, and I’m saddened to see them disputing, especially in public. Benson’s Mediocrefilms channel, one of the most-subscribed, continues to monetize the bulk of the episodes. Ponceman‘s channel has a fraction of the following with about 28,700 subscribers.

If there was (as the Perry brothers claim) an agreement that wasn’t honored, would they have a recourse in YouTube? Or does the video-sharing site have no responsibility here?

Perhaps a YouTube community member will volunteer their services to arbitrate. The show was brilliantly conceived and executed, and we can only hope it will return in some form. We can dream the impossible dream, right?

Best Retarded Christmas Video Ever! Smile With Ponceman!

Folks, I’m going to tell you something. If this video doesn’t go “viral” I’m not just murdering the word viral. I’m declaring Christmas spirit dead forever.

Ponce, best known for The Retarded Policeman, has produced a “Smile the World” video that might very well be the finest Christmas song since “Grandma Got Run Over by a Reindeer.” And certainly the finest Christmas video since, well, “Christmas Vacation.”

I love this song, because it’s a wonderful medley of rock, humor and sincerity. The tweens will love the twang. The adolescents will dig the sexual references. The older dudes will adore the throw-back to glam rock. But most importantly, I am sad for anyone that looks at this with disdain because Ponce is retarded — and assume it’s exploitation. To me, this video reminds us that our mental and physical limitations are trumped by spirit. And the Perry brothers, dear reader, have spirit. I’ve met Ponce, and I can tell you that smile is as real as smiles get.

The Davids vs Goliaths of Online Video

Okay. I gave myself a 15-minute “time out” to reflect on why I have a difficult time wishing success upon the Hulu.com and Strike.tv. models — and a new one I found this morning called Heavy.com. And it comes down to a “David vs. Goliath” perspective.

Online video, to me and many others, represents the opportunity for talented individuals to garner an audience (and profit) without experience, connections or specific talent in one entertainment discipline — writing, directing, acting. I’m hard on Strike.tv, when in fact the initiative is, in fact, its own David against the Goliath of the Hollywood machine.

I’d like to retain a large audience online as Nalts, but I’m quite happy when shows like “The Retarded Policeman” blast past me in views and subscribers (and I take great honor when writer/director Greg Benson refers to me as Geriatric man). I look forward to the day that “Clip Critics” garners an audience well beyond mine. Even shows like PopTub and HBO Labs “Hooking Up” take care to ingratiate themselves to the core online viewers and “stars.” The shows’ motive may be to tap into the vibrant YouTube community, but it still feels polite.

There’s another problem with the format of many online shows on Strike.tv and other sites. They are unrelated “shows” with different target audiences — trying to create another destination site. Success to date via online video is primarily driven by an individual (not a “show”) posting on an already popular video site… not by trying to invent a new network or destination. I can’t fault these guys for trying, because they want to monetize their content, and maintain control. But unless something changes, the creators of these shows will find greater profit by building a larger YouTube audience with a smaller revenue percentage — instead of trying to siphon an audience to an unknown website in hopes that the higher “CPM” advertising revenue will create profit.

This has no precedence of working, even if Hulu enjoys greater revenue (and growing audience) because all of the content is “advertising friendly.” How often does someone return to “Funny or Die” to see if anything as big as “Landlord” is worth checking out? This Stavenhagen’s Food Pawn Shop with Steve Buscemi and Will Ferrell” looks promising, but the site isn’t streaming for me to tell… did someone forget to pay the server bill?

I will continue to root for the “little guys,” like ShayCarl, who has no connections to mainstream media but still has a delicious portfolio and rabid fans. Check out Rhett and Link’s theme song for ShayCarl (due to his victory of the SuperNotes contest). Shay is a family guy who rallies his “ShayTard” viewers like the Pied Piper of YouTube, and his horrible editing and clunky branding (see his homepage banner) makes him “one of us.”

Finally, I hope that new entrants to online video appreciate is that what makes a “show” popular is the lack of a show.

The majority of top YouTube “stars” are in not shows, but individuals doing their own writing, editing, acting and promotion. Sure this may change, but it remains mostly true today. And that’s what fascinates me about online video. It’s also why many of these people — without a proficiency in one creative discipline, but rather a “mix” of many — may not “cross over” to mainstream media. But they are undeniably building a new medium that I quite like — and I’m not alone.
