Deplorable Comedy Insults Handicapped, Ice Cream People & Grease

Get ready for the Lawsuits. In a horrible satire at the expense of handicapped people and ice-cream men, the comedy channel “JustForLaughsTV” created this atrocity below. In addition to stigmatizing one-handed people with “claw hands,” it defaces all ice cream people everywhere. And rips off the soundtrack from “Summer Loving” (Grease).

Parenthetically, the lawsuit by the ice cream man that appeared in my “Creepy Ice Cream Man” video was dismissed earlier this month from federal district court (see court opinion pdf). While the case was dropped because the court has no rulings on most of the plaintiff’s claims, that doesn’t rule out his successive lawsuits in other state courts, federal court, neighborhood court, the Ice Cream court, and the Supreme Court.

Fortunately my defense (based on parody/satire/free speech and the fact that “hurting someone’s feelings” is not grounds for a lawsuit) will require a simple copy/paste and is solid.

Unfortunately no lawsuit will likely help the poor ice cream man (who happened to be selling ice cream when I was inspired to satire my own fear of ice cream people) will reclaim whatever he claims the video did to him. I make that assumption that because my attempts to remedy it more gentleman-like (non-legal) methods have had no apparent effect — apologizing via phone, removing it, filing DCMA claim on unauthorized posts, apologizing in writing, apologizing in person to him and his family, offering a retraction, offering a donation to charity, offering a nuisance settlement, and apologizing again.

The ice cream man even contacted local Pa. media disparaging me, in what could be considered a calculated act of defamation. But I’m not terribly excited about filing a counter suit because, well, ice cream is too delicious to sue.

YouTube “Butt” Guy Sues Southpark

Brownmarkfilms sues Southpark for stealing its “What What In My Butt” YouTube video. Seriously? This is about the highest complement you’ll get in your career.

Hey Southpark… you have my permission to use anything you want from my Nalts channel. It all sucks, but that didnd’t stop you here.

Okay can I insult this video without offending gay people? Because I really think if my favorite sport ever was butt plunging, I’d still find this video pointless.

Officer Bubbles Sues YouTube Commenters

Watch out folks. “Officer Bubbles” (Toronto police constable Adam Josephs) is suing not just the people behind YouTube video parodies of his anti-bubble threat (example from a 2-day old account “MisterOfficerBubbles” channel that’s soon to vanish), but commenters as well. According to this post, Josephs is suing Todd “pussymcfats” Mara (age 33 and father of two) for more than $1 million for spoofing the original clip.

The original video, posted in July 2010, showed the constable warning an anti-G20 protester (nurse Courtney Winkles) not to blow bubbles at him. TheRealNews clip then attracted parodies, remixes and comments.

The Star reports that Josephs is suing and that, “Josephs suggests the cartoons and comments are “false and devastatingly defamatory” for implying that he is a narcissist, among other things.”

The entire event sounds quite familiar to me for reasons I’ve been advised not to express right now. But let’s just say that Josephs is unlikely to improve or recover his tarnished image through the lawsuits, and the parodies are likely covered by free speech and satire. Even if Josephs manages to win or settle for a trivial amount, it won’t likely cover the cost of his attorneys or the increasing damage of the drama.

Would you rather be known as the police officer who became perhaps legitimately frustrated when bubbles were blown in your face, or the guy who tried to sue people who commented on parodies and found it amusing? I think I speak for most employers in saying I’d hire the former, but not the latter.

Lady Bitches About Husband on YouTube. Goes to Court.

Interesting story about a wife that is in court for bitching about him on YouTube.

Tricia Walsh-Smith, 49, is fighting a claim by her estranged husband, Philip Smith, that she engaged in “spousal abuse” by making the videos, which she says have been viewed more than four million times.

She says he was planning to leave her penniless, and that she discovered 77-year-old Mr Smith hoarding the impotence drug Viagra even though they never had sex.
